Definitions

Platform: Gurugyaan.in
User: Any person using the platform, including students and teachers.
Teacher: A registered user who uploads and sells courses or conducts live classes.
Student: A user who purchases courses or attends live classes.
Wallet: A feature that shows real-time earnings of a teacher and allows withdrawals.
Content: Videos, quizzes, assignments, live sessions, messages, and other materials shared.

User Responsibilities

Account Information Each user must keep their account information (such as email, password, etc.) secure. Sharing login details with any third party is strictly prohibited.
Accurate Details All information provided during registration must be accurate and up to date. Providing false or misleading information may result in account suspension.
Respectful Behavior Teachers and students must maintain respectful and professional behavior toward each other on the platform. The use of abusive, inappropriate, or offensive language is strictly prohibited.
Teachers Community Hub Usage This hub is a secure and collaborative space for teachers to share their ideas, experiences, and teaching methods. Your personal information and thoughts remain completely private. Users must ensure that the content shared is ethical, legal, and aligned with educational purposes.
Prohibited Activities Sharing copyrighted material without permission, spreading misinformation, or misusing the platform in any way is strictly forbidden.
Payment Ethics All payments must be made transparently through the platform. Any kind of fraudulent transaction will be considered illegal.
Data Security Gurugyaan takes all necessary technical measures to protect user information. Users are also responsible for maintaining the security of their devices and networks.
Reporting Issues If a user experiences inappropriate content or behavior, they must immediately report it to the Gurugyaan support team.

Privacy & Data Protection

User Rights Users have the right to view, modify, or delete their personal data. For this purpose, they can contact the Gurugyaan support team.
Data Security Practices Gurugyaan uses SSL encryption, secure servers, and conducts regular security audits to ensure user data remains protected.
User Data Collection Gurugyaan collects only essential information such as name, email, contact details, and educational information. This data is used solely to deliver platform services and improve user experience.
Data Usage Collected data is used only for purposes consented to by the user — such as course access, payment processing, notifications, or personalized recommendations.
Data Sharing Gurugyaan does not share users’ personal information with any third party without consent. However, in case of a legal requirement or government order, data may be provided to the concerned authorities.
Payment Information All payments are processed through secure payment gateways. Gurugyaan does not store any user’s bank or card details on its servers.

Intellectual Property & Copyright Policy

Ownership of Content All original content uploaded by teachers — including videos, documents, quizzes, or study material — remains the intellectual property of the respective teacher.
Platform Rights By uploading content to Gurugyaan, teachers grant the platform a non-exclusive license to host, display, and distribute their content for educational purposes only.
Copyright Infringement Users must not upload, share, or distribute any material that violates copyright laws or intellectual property rights of others.

If any copyrighted material is found to be used without permission, Gurugyaan reserves the right to remove such content immediately and may suspend or terminate the user’s account.

Use of Gurugyaan Content All content, branding, design, and logos on the Gurugyaan platform are the property of Gurugyaan. Users are not allowed to copy, reproduce, or use them without written permission.
Reporting Copyright Violations If any user believes their copyrighted material has been used without authorization, they can report it to the Gurugyaan Support Team with valid proof.

Termination & Account Suspension

1. Grounds for Suspension Gurugyaan reserves the right to suspend or terminate any user account if found involved in:

Misuse of platform features
Sharing false or misleading information
Violation of Terms & Conditions
Abusive or inappropriate behavior
Unauthorized sharing of copyrighted material

2. Temporary Suspension

In cases of minor violations, Gurugyaan may issue a warning or temporarily suspend access until the issue is resolved.

3. Permanent Termination

Serious or repeated violations may lead to permanent account termination without prior notice.

4. Teacher Account Termination

If a teacher is found violating ethical standards, sharing harmful content, or misusing the Teachers Community Hub, Gurugyaan may permanently revoke teaching privileges.

5. User Data After Termination

After termination, Gurugyaan may retain certain data as required by law or for security purposes, but personal data will be deleted as per the Privacy Policy.

6. Appeal Process

Users whose accounts have been suspended or terminated can contact the Gurugyaan Support Team to request a review of the decision.

Limitation of Liability & Disclaimer

Platform Responsibility Gurugyaan provides an online platform for educational interaction between teachers and students. However, Gurugyaan is not responsible for the accuracy, reliability, or completeness of any content uploaded by users.
Third-Party Services Gurugyaan may use third-party tools such as payment gateways, video conferencing APIs, or analytics services. The platform is not liable for any issues, data breaches, or losses arising from third-party services.
Technical Failures Gurugyaan does not guarantee uninterrupted or error-free service. Technical issues such as network failures, maintenance downtime, or system errors may occur.
User Conduct The platform shall not be held responsible for any inappropriate, offensive, or illegal behavior by users. Each user is solely responsible for their actions and communications.
Learning Outcomes Gurugyaan does not guarantee academic results, grades, or specific outcomes from any course or teacher. Learning results depend on individual effort and participation.
Limitation of Liability In no event shall Gurugyaan or its affiliates be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform or services.

Governing Law & Dispute Resolution

Applicable Law These Terms & Conditions shall be governed and interpreted in accordance with the laws of India.
Jurisdiction Any dispute arising out of or in connection with the use of Gurugyaan shall be subject to the exclusive jurisdiction of the courts located in [bareilly/uttar pradesh, India].
Dispute Resolution Before taking any legal action, the parties agree to attempt to resolve the matter through mutual discussion, mediation, or arbitration.
Arbitration Clause If the dispute cannot be resolved amicably, it shall be referred to a single arbitrator appointed mutually by both parties, in accordance with the Arbitration and Conciliation Act, 1996 (India).
Language of Proceedings All legal and arbitration proceedings shall be conducted in English or Hindi, as mutually agreed by both parties.
Good Faith Clause Both parties agree to act in good faith and cooperate to resolve disputes in a fair and timely manner.

Updates & Contact Information

Policy Updates Gurugyaan reserves the right to modify, update, or revise these Terms & Conditions at any time without prior notice. The updated version will be posted on the official platform.

Account Registration

The Gurugyaan platform can only be used by individuals who are at least 13 years of age. Users under the age of 18 must have consent from a parent or teacher to use the platform.

Account Creation Users must provide accurate and complete information (such as name, email, and contact details) during registration. Providing false or misleading information may result in temporary or permanent suspension of the account.
Login Credentials Users are solely responsible for maintaining the confidentiality of their email and password. Sharing login credentials with any third party is strictly prohibited.
Account Usage Each account is intended for personal use only. Any kind of fraudulent activity, fake account creation, or misuse of another person’s identity is strictly forbidden.
Account Termination Gurugyaan reserves the right to terminate any user account for policy violations, inappropriate behavior, or legal reasons. Users may also request to delete their account at any time.

Use of Platform

Purpose Gurugyaan is an educational platform designed to connect teachers and students, share knowledge, and make online learning simple and accessible.
Permitted Use Users may use the platform only for educational, teaching, or learning-related activities. Any kind of commercial advertising, spam, or non-educational content sharing is strictly prohibited.
Content Sharing Teachers and students may share their notes, videos, assignments, or ideas, provided that such content does not violate any copyright or law. Users are solely responsible for the accuracy and legality of the content they share.
Communication All discussions within the Teachers Community Hub must remain respectful, professional, and educational in nature. Any offensive, inappropriate, or misleading communication is strictly prohibited.
Prohibited Use The platform must not be used for the following purposes: Illegal activities or violation of laws. Sharing harmful, misleading, or objectionable content. Interfering with the platform’s servers, data, or security systems. Sharing another person’s private information without permission.
Content Ownership The ownership of educational content uploaded on Gurugyaan remains with the respective teacher or user. However, the platform retains limited rights to display or promote such content for educational purposes.

Content Ownership and Licensing

User-Generated Content All educational content uploaded on Gurugyaan — such as videos, notes, presentations, assignments, or articles — shall remain the intellectual property of the respective teacher or user.
Limited License to Gurugyaan By uploading content on the platform, users grant Gurugyaan a non-exclusive, royalty-free, and limited license to: Display the content on the platform, Use it for course delivery or promotional purposes, and Utilize it for platform-related operational activities.
No Transfer of Ownership Gurugyaan does not claim any ownership over the user’s content. Users retain full ownership and rights to their original materials at all times.
Removal of Content Users have the right to remove their content from the platform at any time. However, if the content has already been used as part of a course, promotion, or educational activity, it may continue to be used until that activity is completed.
Prohibited Content Uploading any content that: Violates copyright or trademark laws, Is false, misleading, or offensive, or Breaches any applicable law or regulation is strictly prohibited.

Course Availability and Removal

Course Publishing Teachers can publish their courses, lectures, or study materials on the Gurugyaan platform, provided that the content is educational, accurate, and lawful. Each course may undergo Gurugyaan’s review and approval process to ensure quality standards are met.
Course Availability Published courses will remain available to students for the specified duration or as determined by the teacher. Gurugyaan reserves the right to temporarily or permanently restrict the availability of any course due to technical, policy, or legal reasons.
Course Updates Teachers may modify their course content, pricing, or descriptions at any time. However, all updates must comply with Gurugyaan’s platform policies.
Course Removal by Teacher Teachers have the right to remove their courses from the platform at any time. If a course has already been purchased by a student, it will remain accessible to that student for the duration specified at the time of purchase.
Course Removal by Gurugyaan Gurugyaan reserves the right to remove any course if it: Violates any law, policy, or copyright; Contains inappropriate, misleading, or low-quality content; or Is subject to complaint or investigation.
No Liability Gurugyaan shall not be held responsible for any direct or indirect loss arising from the removal, modification, or unavailability of any course

Payments and Wallet System (For Teachers)

Earnings from Courses Teachers will earn revenue from the courses they publish and sell on the Gurugyaan platform. The earnings will be calculated based on the price set by the teacher, applicable discounts, and Gurugyaan’s commission structure.
Wallet System Each teacher will have a digital wallet within the Gurugyaan platform to track their course sales, earnings, and withdrawals. All transactions — including course purchases, refunds, and bonuses — will be reflected in the wallet in real time.
Withdrawals Teachers can request withdrawals once their wallet balance reaches the minimum withdrawal threshold specified by Gurugyaan. Withdrawals will be processed through verified payment methods such as bank transfer or digital payment gateways, as per the teacher’s registered details. Processing time may vary depending on the payment provider and verification process.
Payment Deductions Gurugyaan may deduct applicable service charges, taxes, or commission fees from the teacher’s earnings as per platform policy and government regulations.
Refunds and Adjustments In case a student receives a refund for a purchased course, the corresponding amount will be automatically deducted from the teacher’s wallet. If the wallet balance is insufficient, Gurugyaan reserves the right to adjust future earnings.
Transaction Transparency Teachers can view a detailed record of all transactions — including course sales, refunds, commissions, and withdrawals — directly in their wallet dashboard.
Fraud Prevention and Compliance Gurugyaan reserves the right to hold or suspend payments in cases of suspected fraud, violation of policies, or incomplete verification. All payments will comply with relevant financial and tax laws.

Code of Conduct

Purpose Gurugyaan's “Code of Conduct” ensures that all users — teachers, students, and other members — maintain a respectful, safe, and educational environment on the platform.

Respectful Interaction
- All users must maintain respect and courtesy towards each other.
- Any kind of offensive, discriminatory, or inappropriate comments are strictly prohibited.
- Discussions should use constructive and professional language.
Academic Integrity
- Any form of plagiarism, cheating, or copied content is unacceptable.
- Both teachers and students must ensure that shared information is original and accurate.
Proper Use of Platform
- The platform should be used solely for educational purposes.
- Posting any kind of spam, advertisements, or promotional content is forbidden.
- No personal information of other users should be shared without their consent.
Privacy and Security
- Users must protect their login credentials and personal data.
- Hacking, data theft, or system interference is strictly forbidden.
Content Standards
- Content uploaded or shared on the platform must be educational, appropriate, and legal.
- Any misleading, offensive, or violent content is prohibited.
- Copyright or trademark violations are not accepted.
Disciplinary Action
If any user violates the Code of Conduct, Gurugyaan may take the following steps —
- Issue a warning
- Temporarily or permanently suspend the account
- Initiate legal action (if necessary)
- The decision of Gurugyaan will be final and binding.

Teacher Conduct and Responsibilities

Professional Behavior
- All teachers must maintain respectful and professional conduct while interacting with students, other teachers, and the Gurugyaan team.
- Any form of offensive, inappropriate, or discriminatory remarks is strictly prohibited.
- Teachers are responsible for upholding the reputation and integrity of Gurugyaan through their behavior.
Authentic and Quality Content
- All content uploaded by teachers must be original, accurate, and educational.
- Any kind of copyright infringement or plagiarism will not be tolerated.
- It is the teacher’s responsibility to regularly update the content and ensure it remains relevant for students.
Transparency in Communication
- Teachers should respond to student queries respectfully and clearly.
- False promises or misleading information must not be shared.
- Transparency regarding course objectives, duration, and pricing is mandatory.
Fair Use of Platform
- The platform must be used solely for teaching and learning purposes.
- Use of external websites, advertisements, or promotions without permission is strictly prohibited.
- Discussions shared in the Teachers Community Hub must remain confidential and educational.
Student Privacy
- Teachers must not share students’ personal information (such as contact numbers, emails, etc.) under any circumstances.
- All communications with students should be conducted with respect and sensitivity.
Compliance with Policies
- Teachers must comply with all Gurugyaan policies, guidelines, and applicable laws.
- In the event of a policy violation, Gurugyaan reserves the right to suspend or terminate the teacher’s account.
Consequences of Misconduct
If a teacher violates the code of conduct or any Gurugyaan policy, the platform may take the following actions:
- Issue a warning
- Temporarily or permanently suspend the account
- Withhold or revoke payments
- Take legal action, if necessary

For Students

Access to Courses
- Students will have access to purchased courses only through the Gurugyaan platform.
- Temporary interruptions may occur due to maintenance or technical upgrades.
- Gurugyaan will make reasonable efforts to notify students in advance.
Course Content and Updates
- Gurugyaan ensures that all course materials are accurate and regularly updated.
- In case a course is removed or modified, students may be offered an alternative course or extended access.
Data Privacy and Security
- Students’ personal information (name, email, payment details, etc.) will remain secure and confidential.
- Students must not share their login credentials with others.
Technical Issues and Support
- Gurugyaan’s support team will assist students facing technical issues via email or chat.
- Students are expected to provide necessary details (e.g., screenshots or error messages) to resolve issues efficiently.
Compliance with Platform Rules
- Students must comply with all policies, terms, and the platform’s code of conduct.
- Any misuse (such as course sharing, copying, or policy violations) may result in account suspension or termination.

Platform Rights and Maintenance

Ownership and Authority
- The Gurugyaan Platform and all its components are owned and controlled by the Gurugyaan team.
- Gurugyaan reserves the right to modify, update, or discontinue any feature or service at any time.
- Users (teachers/students) are granted a limited license to use the platform; no ownership rights are transferred.
Platform Updates and Maintenance
- Gurugyaan regularly performs updates for security, performance, and feature enhancement.
- During maintenance, certain services may be temporarily unavailable.
- Users will be informed in advance wherever possible.
Data Backup and Security
- Gurugyaan employs necessary measures to maintain data security and confidentiality.
- However, Gurugyaan shall not be liable for any data loss caused by unforeseen technical issues or external attacks.
- Users are advised to keep a personal backup of their important data and content.
Modification or Discontinuation
- Gurugyaan reserves the right to alter, restrict, or discontinue any part of the service without prior notice.

Limitation of Liability

Platform Usage
- Gurugyaan acts as an online education platform connecting teachers and students.
- All courses, materials, and services are provided on an “as-is” basis.
- Gurugyaan makes no warranties regarding accuracy, completeness, or uninterrupted access.
Technical Issues
- Gurugyaan will not be liable for any interruptions or failures caused by server errors, network issues, or other technical malfunctions.
- However, the team will make reasonable efforts to resolve such issues promptly.
Financial Loss
Gurugyaan shall not be responsible for any indirect, incidental, or consequential damages — including loss of profit, data, or business interruption — arising from platform usage or course access.
Third-Party Content or Links
Gurugyaan is not responsible for the accuracy, legality, or safety of any third-party content or external links shared on the platform.
Instructor’s Responsibility
- Teachers are solely responsible for the accuracy, quality, and legality of their course content.
- Gurugyaan assumes no liability for any misleading, plagiarized, or incorrect information provided by instructors.
Maximum Liability
In no event shall Gurugyaan’s total liability exceed the amount paid by the user for the relevant transaction.

Account Termination

Voluntary Termination by User —
- Any user (teacher or student) may request to delete their Gurugyaan account at any time.
- Upon deletion, all associated data — including profile, courses, and wallet information — will be permanently removed unless retention is required by law.
Termination by Gurugyaan —
Gurugyaan reserves the right to suspend or terminate any account in the following cases:
- Violation of platform policies, terms, or Code of Conduct.
- Misleading, inappropriate, or illegal activities.
- Submission of false, misleading, or incomplete information.
- Copyright infringement or valid complaint related to uploaded content.
- Fraudulent transactions or payment irregularities.
Suspension —
- Accounts may be temporarily suspended during verification or investigation.
- Access to courses or features may remain restricted during the suspension period.
Effect of Termination —
- Upon termination, users will lose access to all courses and services on the platform.
- Pending payments (for teachers) may be released only after successful verification.
- Gurugyaan may retain certain data for legal or security purposes.
Appeal Process —
- Users may appeal account termination by contacting Gurugyaan Support.
- Gurugyaan’s decision regarding reinstatement will be final and binding.

Dispute Resolution

Mutual Resolution
In the event of any dispute, complaint, or disagreement, the user and Gurugyaan shall first attempt to resolve the matter amicably through mutual discussion and cooperation.
Contacting Support Team
- For any dispute or complaint, the user must first contact Gurugyaan’s official support team via email or through the Help Center.
- The support team will review the matter and make every effort to provide an appropriate resolution.
Mediation
- If the issue cannot be resolved through direct communication, the matter may be settled through mediation.
- In this process, both parties will seek the assistance of an independent mediator to reach a mutually agreeable solution.
Legal Proceedings
- If mediation fails, the dispute shall be resolved under the applicable laws of India and within the jurisdiction of Indian courts.
- All legal proceedings shall take place in the courts of New Delhi, India.
Binding Decision
Any decision or judgment made through mediation or by the court shall be final and binding on both parties.
Fees and Expenses
All fees and expenses related to mediation or legal proceedings shall be borne by each party individually, unless otherwise mutually agreed upon.

Changes to Terms

Right to Modify Terms
Gurugyaan reserves the full right to change, modify, or update these Terms and Conditions at any time.
Notification
- In the event of any change, Gurugyaan will notify users through the website, mobile app, or official email notifications.
- However, if, due to a technical issue, the notification does not reach the users, Gurugyaan will not be responsible for it.
Effective Date of Changes
The revised terms will become effective from the date specified in the notification. Users are advised to review the Terms regularly to stay informed about any updates.
Acceptance of Terms
By continuing to use the Gurugyaan platform after such changes, users are deemed to have accepted the new or modified Terms and Conditions.
Right to Object
